Just like clockwork, as Mariah Carey officially announced ‘it’s time’ for Christmas, her iconic festive banger has found its way back to the charts. 

All I Want For Christmas Is You, the singer’s 1994 classic, has been forced to spend the year in hibernation to allow for other events such as, you know, Easter, Halloween, the revolving door of British Prime Ministers. 

However, it’s now reclaimed its rightful place on the charts after re-entering the countdown in the US.

According to Kworb, AIWFCIY has made it back into the iTunes Top 40 chart and is currently at number 26 after jumping 55 places. At the moment, it’s sandwiched in between Michael Jackson’s Thriller – which no doubt benefited off the Halloween hype – and Harry Styles’ As It Was. 

However, the Official Charts in the UK has confirmed to Metro.co.uk that AIWFCIY isn’t currently inside our Top 100 but, after her November 1 announcement, that could easily change by next week. 

It comes hours after Mariah cut the ribbon on the festive season as soon as the clock struck midnight on November 1, ending the spooky season. 

A video shared on social media opens with the Grammy-winning singer dressed as a witch and cackling away while riding a static exercise bike against a backdrop of a dark forest filled with glowing pumpkins. 

As the date is shown reaching November 1, the day after Halloween, the scene transforms to show a more festive picture. 

Mariah, dressed as Mrs Claus in a red jumpsuit and black belt with white fur around the collar, swaps the exercise bike for a reindeer with a snowy backdrop behind her. 

She then belts out a piercing note while singing ‘it’s time’ as the familiar jingles of her AIWFCIY begins playing.

It coincides with reports that a lawsuit she was facing over AIWFCIY has been dropped.

The singer released the track in 1994 as part of her album Merry Christmas, but she and her co-writer Walter Afansieff had been accused of copying the track by songwriter Andy Stone and Vince Vance. 

However, Billboard reports that in a court filing on Tuesday, Vance’s attorneys moved to voluntarily dismiss the case against Mariah. 

However, the door will be left open for Vince to refile the lawsuit at a later date.

In his original lawsuit, Vance claimed he had recorded his own All I Want for Christmas is You’ in 1989 and it had received ‘extensive airplay’ during the 1993 festive season, a year before Mariah released her hit under the same title.

Vance branded the later track a ‘derivative’ of his own and was seeking $20million in damages from the 52-year-old singer, her co-writer Walter Afanasieff and Sony Music.

Paul Fakler, music litigator at Mayer Brown, said when the case was filed: ‘The only similarity he claims is in the title of the song, not the music or lyrics. Words and short phrases are not protectable under copyright law, and there are dozens of other songs with that same title.’ 

It’s not known why the lawsuit was dropped.
