Ezra Miller has reportedly agreed to plead guilty to a trespassing charge in Vermont.

The DC star is said to have agreed to the plea in the hopes of having other charges – specifically burglary and larceny – in the same case dropped.

Miller, 30, has had a tumultuous couple of years and found themselves at the centre of various legal issues.

The Flash actor – who is non-binary and uses they/them pronouns – is alleged to have stolen bottles of alcohol from a home in Stamford in May.

Their alleged actions resulted in them being charged with two counts of burglary in an unoccupied dwelling, unlawful trespassing and petit larceny.

According to a Vermont Superior Court clerk, Miller will be expected to enter a guilty plea to trespass and have their larceny and burglary charges dropped.

Court documents seen by NBC News recommend Miller – who previously pleaded not guilty to the theft charges – be slapped with a suspended sentence of up to 90 days, receive a year’s probation, and pay a fine of $500 (£410).

The document is also said to claim that Miller could face up to 25 years in prison on a burglary charge.

It was reported in October that Miller had pleaded not guilty to the felony burglary charges.

Police received notification of a burglary complaint from a property in the area on May 1 and found that several bottles of alcohol had been taken from the residence while the owners were not home.

After collecting statements and assessing CCTV footage, officers were said to have found ‘probable cause’ to charge Miller with ‘felony burglary into an unoccupied dwelling’.

They were eventually located and summoned to appear in Vermont Superior Court on September 26, but the hearing was pushed back to October 17.

According to Deadline, the Hollywood name appeared remotely for the session, and was asked to stay away from the owner of the property they allegedly entered, as well as another Vermont local.

Miller agreed to five conditions, the publication reported, including not having any contact with either Vermont resident.

‘We agree to those conditions,’ their lawyer, Lisa Skelkrot, told the judge, as they added: ‘I do understand.’

The We Need To Talk About Kevin lead has been making headlines over recent months after several run-ins with the law.

They were also arrested twice in Hawaii on charges of second-degree assault and disorderly conduct.

Addressing their behavior in a statement shared with Variety, Miller apologised for their actions.

‘Having recently gone through a time of intense crisis, I now understand that I am suffering complex mental health issues and have begun ongoing treatment,’ they said.

‘I want to apologise to everyone that I have alarmed and upset with my past behaviour.
