Home Alone actor Devin Ratray’s domestic violence trial has been delayed after lawyers told the court he was in hospital, it has been reported.

The 47-year-old child star who played Buzz McCallister in the Christmas classic film was said to be ‘in critical condition’.

Ratray was in a New York City hospital but doctors have since sent him home to rest, a family member told TMZ.

It is not clear what caused the actor’s hospitalisation, but the medical situation has forced his domestic violence trial back by a month.

It was due to begin with jury selection in Oklahoma on Monday, with his first court appearance having taken place in February 2022, in which he pleaded not guilty.

Ratray was arrested in December 2021 for domestic violence after allegedly attempting to strangle his girlfriend.

It was understood he turned himself into law enforcement at the Oklahoma City Police Department after the incident.

At the time it was reported he was released on a bond of $25,000 (£18,655).

He was reportedly accused of attacking his girlfriend after she gave out his autograph cards to fans without charging them money.

The actor, who first hit the screens in 1990 on the Christmas film, reportedly consumed a bottle of wine and shots before the argument with the woman, which took place in a bar.

She alleged he pushed and tried to strangle her back in their hotel room that night, and an affidavit alleged Ratray told her ‘this is how you die’ as he choked her, before she bit his hand and broke free.

The report alleged Ratray then punched her in the face, and as she returned to the room to collect her belongings he pushed her against a desk.

The woman reportedly suffered bruising and marks on her face, a bruise on her chest and pain in her right arm.

He denied the allegations, with representatives for the actor saying that the couple had got into an argument but it was not physical and they had since split.

In 2022, US outlets reported Ratray was also accused of raping a friend in New York in a separate incident.

The actor allegedly attacked Lisa Smith at his Manhattan apartment in 2017, as she claimed he drugged and sexually assaulted her.

Having gone to the police shortly after the alleged rape, the news of Ratray’s arrest in December 2021 spurred Smith on to question why her report wasn’t actioned.

She was informed that officers incorrectly thought that she didn’t want to press charges, and decided to close the case – a move that left her ‘devastated’.

According to CNN, Smith and Ratray had been friends for more than a decade.

Smith told the publication that she, her brother, another friend, and Ratray were back at the latter’s apartment when he allegedly seemed intent on giving her a specific glass, after which she became exhausted and was encouraged to sleep over.

‘I remember waking up and I couldn’t move,’ she said. ‘I couldn’t really open my eyes, but I could hear what was happening and I could feel what was happening. I knew that the other two people were gone and I was still on the couch.’

She alleged that Ratray sexually assaulted her for what seemed like ‘an eternity’, before leaving her on the sofa.

The publication reports that Smith confronted the Blue Ruin star in text messages the next day, but he denied assaulting her, claiming that he was unable to have sex because he is impotent.

Ratray has denied all allegations against him and told the outlet that they ‘did not have sex’.
